1. About This Policy
This FIX Board Advertising Policy (the "Policy") is a binding agreement between FIX SERVICE CORP ("FIX SERVICE," "we," "us," or "our") and the business that applies for, pays for, or publishes an advertisement on FIX Board (the "Advertiser," "you," or "your"). FIX Board is the local business advertising board on the FIX SERVICE website and customer app, currently published as the New York Ad Board at https://fixservicenyc.com/advertise-ny.
This Policy applies together with our Terms of Use and Privacy Policy. If they conflict on a FIX Board matter, this Policy controls.
2. Electronic Acceptance
You accept this Policy by checking the agreement boxes and submitting a FIX Board request in your FIX SERVICE account. That acceptance is your electronic signature and has the same validity and effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) and the New York Electronic Signatures and Records Act (N.Y. State Technology Law § 304).
If our team creates a listing for you, you accept this Policy by signing our order form or by confirming in writing, including by email or text message, before the listing goes live.
We keep a record of the account that accepted, the date and time of acceptance, the IP address used, and the version of this Policy. The person who accepts confirms that they are at least 18 years old and authorized to act for and bind the business.
3. What FIX Board Is
- Every listing on FIX Board is an advertisement, and we present it as advertising.
- FIX SERVICE does not endorse, recommend, certify, license, or guarantee any Advertiser or its goods or services. Customers deal with Advertisers directly.
- FIX Board is for lawfully operating businesses and professionals. It is not a place for personal classified ads.
- Placement is not exclusive: we may publish ads for other businesses in your category.
4. The FIX BOARD BUSINESS Package
The package includes:
- Video shoot. We come out and film your business.
- Promotional video. A finished video for your listing.
- Photos. Images for the listing.
- Description. We write the text about your business.
- FIX Board publication. A designed listing on FIX SERVICE.
- Support. We stay in touch about your listing.
The package includes ONE on-location shoot. Additional shoots, new videos, reshoots, and changes beyond correcting factual errors are separate paid services, quoted before any work starts.
The package does not include paid promotion on third-party platforms, social media management, or any guaranteed number of views, calls, leads, customers, or sales.
5. Price, Payment, and Term
- Price. Placement costs $200 per month. The contract runs for 12 months, unless a different price or term is shown to you in writing before you pay. Prices are in U.S. dollars. If any tax applies to your purchase, it will be shown before you pay.
- Deposit at signup. At signup you pay $600, which covers the last 3 months of the contract. This deposit is required and is non-refundable once production of the advertising materials has begun.
- Monthly payments. Monthly payments begin on the placement date and are charged automatically to the payment method you provide, until the contract ends or you close your listing. The first charge therefore includes both the deposit and the first month, and that total is shown to you before you pay.
- Order of steps. Request → our review → approval → payment → your listing goes live on FIX Board. We schedule the shoot after approval. Your listing may go live before your video is ready, with a standard image for your category, and we add the video, photos, and final description when they are ready.
- No payment before approval. We do not charge anything for a request that we have not approved.
- How you pay. Card payments are processed by Stripe on its secure hosted checkout page. FIX SERVICE never sees or stores your full card number. We may also accept other payment methods at our shop.
- Placement term. The 12-month term starts on the first day your listing is live on FIX Board, which happens once your payment is confirmed, online or at our shop.
- Closing your listing. You may ask us to close your listing at any time from your account. Your listing stays on the board for a short grace period, during which you can change your mind, and then it is removed and the monthly charges stop. Months already paid for in advance are not refunded when you close the listing early.
6. Review and Approval
We review every request and every change. We may approve a request, ask for changes, or decline it, for example for legal compliance, accuracy, quality, safety, brand fit, conflict with FIX SERVICE's own services, or limited availability. If we decline a request, we tell you the reason in your account where practical, and you are not charged.
Editing a request, or an approved ad that is not yet published, sends it back to review. After publication, changes are made by our team at your request.
7. The Shoot and Your Content
- Scheduling. After approval, we contact you to agree on a shoot date at your business in New York City or at another location we agree on. We may ask you to pay before the shoot takes place.
- Access and permissions. You give our crew access to the location at the agreed time and confirm that you are allowed to permit filming there, including any landlord or building permission.
- Rescheduling. Please tell us at least 24 hours in advance if you need to move the shoot. If the shoot cannot happen at the agreed time because of you, we reschedule once at no charge. Any further shoot is a separate paid service.
- People on camera. Under New York Civil Rights Law §§ 50–51, a person's name, portrait, picture, likeness, or voice may be used for advertising only with that person's written consent. Before filming, every person who will appear or speak in your ad, including your employees (and, for a minor, a parent or guardian), must sign our written release allowing you and FIX SERVICE to use their name, image, and voice as described in Section 11. You are responsible for arranging these releases with your staff and anyone you bring on camera. We do not film anyone who has not signed, and we avoid filming customers who happen to be at your location.
- Your information. Your listing starts with the information you submit, and we may edit it for clarity, accuracy, and length. You are responsible for the accuracy of every fact and claim about your business, including prices, discounts, licenses, experience, results, awards, and reviews.
- Corrections. We add the video, photos, and description to your listing when they are ready. If you find a factual error in your listing at any time, tell us and we will correct it at no charge. Editing, style, music, and layout are our creative decisions within the package.
8. Advertising Standards
Every ad must be truthful, not misleading, and backed by evidence at the time it is published. This reflects federal and New York law, including Section 5 of the Federal Trade Commission Act (15 U.S.C. § 45), New York General Business Law §§ 349 and 350, and Section 43(a) of the Lanham Act (15 U.S.C. § 1125(a)). In particular:
- Claims. Statements such as "best," "#1," "licensed," "insured," "certified," or "guaranteed," and any claim about results or savings, must be true and supported by evidence you can provide on request.
- Prices and offers. Advertised prices, discounts, and "free" offers must be real, currently available, and state their material conditions (see the FTC Guides Against Deceptive Pricing, 16 CFR Part 233).
- Reviews and testimonials. Reviews and testimonials must be genuine and reflect real customers' experiences. Fake, purchased, or undisclosed insider reviews, and fake followers or engagement, are not allowed (FTC Rule on the Use of Consumer Reviews and Testimonials, 16 CFR Part 465). Any material connection between you and an endorser must be clearly disclosed (FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising, 16 CFR Part 255).
- Images. Photos and before-and-after images must show your real work and must not be altered in a misleading way.
- Licenses. If your business requires a government license, registration, certification, or permit (for example, home improvement, health care, legal, financial, real estate, child care, or transportation services), you must hold it, keep it current, and show the license number in the ad wherever the law requires. We may ask for proof.
- No discrimination. Ads must not express a preference, limitation, or discrimination that federal, New York State, or New York City law prohibits, including in housing and employment ads (for example, 42 U.S.C. § 3604(c), N.Y. Executive Law § 296, and N.Y.C. Administrative Code § 8-107).
- Intellectual property. You may use only names, logos, trademarks, images, music, and other materials that you own or are allowed to use. Comparisons with competitors must be fair and accurate.
- Contacts and links. The phone number, address, and website in your ad must be your own real business contacts. Links must work, be safe, and lead to content consistent with the ad.
9. Prohibited Ads
We do not accept ads that promote, offer, or contain:
- adult or sexual content, or escort or dating services;
- political, election, or issue advertising;
- cannabis, tobacco, e-cigarette, vaping, or nicotine products, illegal drugs, or drug paraphernalia;
- firearms, ammunition, explosives, or other weapons;
- gambling or betting;
- alcohol offers aimed at people under 21, or ads that encourage excessive drinking (a restaurant or bar may advertise its venue responsibly);
- counterfeit or stolen goods, pirated content, or materials that infringe anyone's rights;
- goods or services that are illegal or that you are not licensed to provide;
- pyramid or multi-level schemes, "get rich quick" offers, promises of guaranteed income, or investment and cryptocurrency offers;
- payday loans, or debt relief or credit repair offers that promise guaranteed results or require fees in advance;
- prescription drugs, unproven medical treatments, miracle cures, or weight-loss guarantees;
- false, deceptive, defamatory, hateful, violent, harassing, or shocking content;
- content that exploits or endangers minors;
- malware, phishing, or requests for sensitive personal or financial information;
- anything else that is unlawful under federal, New York State, or New York City law.
10. Your Promises
You represent and warrant that: (a) your business exists and operates lawfully; (b) you are authorized to act for it; (c) all information you give us is accurate and complete; (d) you hold every license and permit your business requires; (e) you own or have the right to use all materials you provide; (f) you have the written consents described in Section 7; and (g) your ad complies with this Policy and the law. You will tell us promptly about any change that makes your ad inaccurate, such as a new phone number, a lost license, or the closure of the business.
11. Ownership and Use of Content
- Your materials. You keep ownership of your business names, logos, trademarks, and the photos and texts you give us. You give FIX SERVICE a non-exclusive, royalty-free license to use, copy, format, and display them to produce and publish your ad on FIX Board and on the FIX SERVICE website and app during the placement term, for the portfolio use described below, and to keep archive copies as business records.
- Content we create. FIX SERVICE owns the video, photos, and text it creates for the package, including all copyrights. After you pay in full, you receive a non-exclusive, royalty-free, non-transferable license to use that content to promote your own business, including on your website and social media, with no time limit. You may not sell or license it to others, or remove credits that appear in it.
- Showing our work. While your ad is live and for 12 months after your placement ends, FIX SERVICE may show your listing and the content we created for it as an example of FIX Board advertising on its own website, app, and social media, unless you ask us in writing not to.
- After the term. When the placement ends, we remove the listing from FIX Board. We may keep copies for our records, dispute resolution, and legal compliance, and use them as described under "Showing our work."
12. Public Information and Statistics
Your business name, category, description, address or service area, phone number, website, photos, and video are shown publicly on FIX Board and may be seen, copied, or shared by anyone. Do not give us personal information that you do not want to be public.
Views and clicks shown in your account are counted by our systems: a view each time the board page showing your listing is loaded, and a click each time someone taps a contact button on your listing, such as Call or Visit site. These numbers are provided for information only. We do not guarantee any number of views, calls, leads, customers, or sales, or any particular position of your listing on the board.
13. Removal, Suspension, and Complaints
We may pause, correct, or remove an ad at any time if we reasonably believe that it violates this Policy or the law, it receives credible complaints, the business closes or loses a required license, its phone number or link stops working, or a law or government request requires it. Where practical, we tell you why and give you a chance to fix the problem first. If we hide an ad while we review a report and find no violation, we make up the hidden days by extending your placement or refund them as described in Section 14.
Anyone can report an ad by email to Fixservicenyc@gmail.com with the business name and the reason. A rights holder who reports infringement should include the work claimed to be infringed, the listing where it appears, contact information, a statement of good-faith belief that the use is not authorized, and a statement that the report is accurate and that the sender is authorized to act for the rights holder. We may hide the ad while we review a report.
14. Cancellation and Refunds
- Before payment. You may withdraw your request at any time before the shoot, and nothing is charged. If the shoot takes place before you pay, the package fee is due within 7 days after the shoot.
- After payment, before the shoot. If the shoot has not started and our team has not travelled to the location, you may cancel by contacting us, and we refund what you paid minus the placement time already used, prorated as described below.
- After the shoot. Except as stated under "If we cannot deliver," the $600 deposit is non-refundable once we travel for the shoot or production begins, because it covers preparation, filming, photography, editing and production of the advertising materials.
- If we cannot deliver. If we cannot perform the shoot for reasons on our side (for example, our crew is unavailable and we cannot agree on a new date), or we do not add your video to your listing within 30 days after the shoot, you may choose a full refund. If we remove your ad before the end of the term for a reason that is not your fault (for example, we close FIX Board), we refund the unused placement time.
- How we prorate. A refund for placement time equals the amount you paid, multiplied by the number of days in question, divided by the total number of days in your placement term.
- Violations. If we remove an ad because it violates this Policy or the law, no refund is due.
- Chargebacks. Please contact us before disputing a charge with your bank. If you open a payment dispute, we may pause your listing until the dispute is resolved.
- How refunds are paid. Refunds go back to the original payment method where possible. If you have a billing concern, please contact us first so we can resolve it quickly.
This section is the refund policy for FIX Board purchases and applies in place of our general Refund Policy for them, except where the law gives you greater rights.
15. Disclaimers
FIX Board is provided "as is" and "as available." To the extent permitted by law, FIX SERVICE disclaims all implied warranties, including merchantability and fitness for a particular purpose, and does not promise that FIX Board will be uninterrupted or error-free.
16. Limitation of Liability
To the maximum extent permitted by law, FIX SERVICE's total liability for all claims related to FIX Board, combined, is limited to the amount you paid for the affected package. FIX SERVICE is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business opportunities. These limits do not apply to bodily injury caused by us, to our gross negligence or willful misconduct, or to any other liability that cannot be limited under applicable law.
17. Indemnification
You will defend, indemnify, and hold harmless FIX SERVICE, its owners, employees, and contractors from claims, losses, fines, and costs (including reasonable attorneys' fees) arising from the information and materials you provide, your goods and services, your breach of this Policy or of the law, or any claim by a person who appears in your ad that the release you were responsible for arranging was not obtained. This obligation does not apply to the extent a claim is caused by changes we made to your materials, materials we selected, or our own negligence or misconduct.
18. Relationship of the Parties
FIX SERVICE and the Advertiser are independent businesses. This Policy does not create a partnership, joint venture, agency, franchise, or employment relationship, and neither party may bind the other.
19. Changes to This Policy
We may update this Policy. The version and the date of the last update are shown at the top. Updates apply to new requests from the date they are published. A contract you have already entered continues under the version you accepted, unless a change is required by law. A new request requires acceptance of the current version.
20. Governing Law and Disputes
This Policy is governed by the laws of the State of New York, without regard to conflict of law principles, except where federal law applies. If you have a concern, please contact us first so we can try to resolve it. Any court proceeding arising from this Policy or FIX Board shall be brought only in the state courts located in Richmond County, New York, or in the United States District Court for the Eastern District of New York, and each party consents to the personal jurisdiction of those courts. Nothing in this Policy prevents either party from using a small claims or commercial claims court where available, or from filing a complaint with a government agency.
21. General Terms
- Entire agreement. This Policy, together with our Terms of Use, Privacy Policy, and any written confirmation of your order, is the entire agreement about FIX Board.
- Severability. If any part of this Policy is found unenforceable, the rest remains in effect.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not transfer your rights under this Policy without our written consent. We may transfer ours as part of a sale or reorganization of our business.
- Notices. We send notices to the email address or phone number in your account. You can send notices to the contacts below.
- Events beyond control. Neither party is responsible for a delay or failure caused by events beyond its reasonable control, such as severe weather, power or internet outages, or government orders. If such an event affects your shoot, we agree on a new date.
- Survival. Sections 3, 10, 11, 14 through 18, 20, and 21 continue to apply after your placement ends or your request is withdrawn, cancelled, or declined.
